  1. definitions

article : fashion product offered for sale on the site.

customer : non-commercial natural person placing the order and holding full legal capacity.

  1. application of the general conditions of sale

these general conditions of sale (the " cgv ") apply exclusively, without restriction or reservation, to any order of article placed via the site by any customer with salut beauté.

 

given the possible evolutions of the site and the regulations, salut beauté reserves the right to modify the general terms and conditions of sale at any time. the new terms and conditions will, where applicable, be brought to the attention of the customer by online modification. the general conditions of sale applicable to any sale are those appearing on the site at the time of placing the order.

 

any order on the site is subject to consultation and prior and unreserved acceptance by the customer of the terms and conditions and the applicable prices.

 

the validation of an order following the order procedure proposed on the site implies acceptance of the terms and conditions and the associated costs.

 

these terms and conditions prevail over any other document.

 

  1. creation of a customer account

to be able to place an order on the site, the customer must first create an account containing the customer's identification data (the " account ").

the creation of an account is reserved for non-trading natural persons, aged at least 18 and holding full legal capacity.

the client's registration on the site is validated by salut beauté after verification of the standard form completed by the client. the customer receives a registration confirmation email.

when creating his account, the customer enters the data that allows his identification under his full responsibility, controls and directions, and undertakes to communicate complete, accurate and up-to-date information, and not to usurp the identity of a third party, or to hide or change their age. the customer is required to always update his personal information. in the event of an error in the wording of the recipient's contact details, salut beauté cannot be held responsible for the impossibility of delivering the items.

when creating his account, the customer chooses his username (e-mail address) and his password. if the chosen identifier is already assigned, the system prompts him to choose another one.

the username and password are personal and confidential. the customer is solely responsible for this.

the customer agrees to keep his password secret and not to disclose it under any circumstances and in any capacity whatsoever.

in the event of suspicion of the use of the username and password by a third party, the customer must immediately alert Salut beauté in order to change his password and/or choose to have his account closed.

salut beauté reserves the right to close any account and consequently refuse any sale to a customer in the following cases:

  • non-payment of one or more previous orders;
  • abusive, unfair or fraudulent use of the ordering service offered on the site or non-compliance with any of the customer's obligations defined in the terms and conditions;
  • previous orders clearly validated by a professional seller customer.

in this case, salut beauté sends an e-mail to the customer concerned at the address communicated by the latter when creating his account informing him of the deactivation of his username and password and the closing of his account.

in general, the customer is informed that his account may be closed following the customer's first request sent by e-mail to salut beauté at the following address: salut@salut-beaute.com.


  1. items

the items offered for sale are those which appear on the site on the day of the consultation of the site by the customer, within the limit of available stocks.

salut beauté reserves the right to withdraw from sale, at any time, any article present on the site and/or to replace or modify any information associated with the articles appearing on this site.

the indications relating to the availability of the articles are updated automatically in real time. however, an error in the update, whatever its origin, does not engage the responsibility of salut beauté. as such, salut beauté cannot be held responsible for the cancellation of an order for an item due to the depletion of stocks. in the event of the unavailability of an article, after placing his order, the customer is informed by e-mail, his order then being automatically cancelled.

the characteristics of the items sold on the site (photographs, graphics, item descriptions, etc.) may vary over time. only the characteristics of the article displayed at the time of the order must be taken into account by the customer. in the event of errors or omissions relating to the description of an article, the responsibility of salut beauté is limited to the reimbursement of the reasonable costs of returning the article exposed by the customer.

it is possible that the customer receives following an order a part previously returned by another person. it is specified that salut beauté only accepts the return of new, unworn and unwashed items, these conditions being checked before the returned items are returned to stock.

 

  1. orders

order taking on the site is subject to compliance with the procedure set up on the site comprising successive stages leading to the validation of the order. it implies an obligation to pay.

the customer who places the order declares to be the natural person who opened the account associated with the order.

the customer can select as many articles as he wishes which will be added to the basket (the “ basket ”). the sale of items on the site being exclusively reserved for retail and private individuals, no order may be placed by professional sellers, alone or in groups, regardless of the method of marketing their products (places of internet market, shopping malls, intermediaries, physical stores in particular). the customer therefore acknowledges and accepts that the items can only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of items ordered in a single order and the number of individual orders respecting the usual amount an average consumer spent for the same product. salut beauté reserves the right to refuse an order clearly validated by a professional seller.

the basket summarizes the items chosen by the customer as well as the prices and costs relating thereto. the customer can freely modify the basket before confirming his order.

the validation of the order by the customer is worth confirmation of the acceptance by the customer of the general terms and conditions, the items purchased, their price as well as the associated costs.

after validation of the payment, salut beauté sends the customer an e-mail confirming his order.

all orders are subject to the prior acceptance of salut beauté and are not definitively confirmed until the customer has received an e-mail confirming the dispatch of the item(s). the customer formally accepts the use of e-mail for confirmation by salut beauté of the content of his order.

the customer will be able to obtain the invoice relating to any order by sending an e-mail specifying the number of the order concerned to salut@salut-beaute.com.

if the customer does not receive any e-mail following his order, it is up to him to contact the customer service of salut beauté according to the methods described in article 12 of the cgv.

salut beauté can in no way be held responsible in the event of an input error or transmission of an input error that does not allow the delivery of the confirmation e-mail and/or articles.

for any question relating to the follow-up of an order, the customer must consult his account on the site or contact the customer service according to the methods described in article 12 of the cgv.

salut beauté reserves the right to withdraw at any time any article displayed on the site and to replace or modify any content or information appearing on the latter. despite the best efforts of salut beauté to meet the expectations of its customers, it may be necessary for the latter to refuse to process an order after having sent the customer the confirmation e-mail summarizing the order.

salut beauté cannot be held liable to the customer or a third party for the decision to withdraw an article from the site, or for the decision to replace or modify any content or information appearing on this site, or for the refusal to process a order after sending the confirmation e-mail summarizing the order.


  1. price

the prices of the items are indicated on the site in euros, value added tax (“VAT”) included, but excluding:

  • customs fees and other taxes, which must be paid by the customer directly to the carrier;
  • shipping costs in mainland france, the amount of which is specified before validation of the order on the site in the "deliveries and returns" section;
  • shipping costs outside mainland France, the amount of which is specified before validation of the order on the site in the "deliveries and returns" section;
  • additional costs related to any foreign currency conversion costs, depending on the payment method chosen by the customer

the prices take into account any reductions applicable on the day of the order.

any new taxes or contributions, in particular environmental, are likely to be passed on to the selling price of the items.

salut beauté reserves the right to modify the prices of the articles at any time, the articles being invoiced on the basis of the prices in force at the time of the validation of each order, subject to availability.

the price of the items invoiced to the customer is the price indicated in the order confirmation sent to the customer by e-mail.

 

  1. payment terms

the items are payable in cash when the actual order is placed.

payment for items is made either via paypal or by bank card (cb, visa, mastercard, american express) via the secure online payment platform stripe.

the customer expressly acknowledges that the communication of his credit card number to salut beauté constitutes authorization to debit his account up to the price of the items as indicated during the confirmation of the order. if necessary, a notification of cancellation of order for non-payment is sent to the customer by salut beauté on the e-mail address communicated by the customer when registering on the site.

the data recorded and kept by salut beauté constitutes proof of the order and of all past sales. the data recorded by paypal or stripe constitutes proof of any financial transaction between the customer and salut beauté.

 

  1. delivery

delivery means the transfer to the customer of physical possession of the item(s) (the " delivery ").

the risk of loss or deterioration of the article(s) is transferred to the customer at the time of delivery.

during the validation of his order, the customer is offered several delivery options, namely:

  • home delivery by colissimo services;
  • collection of the order from our premises in Paris, by appointment.

standard home delivery by Colissimo (with tracking – without signature)

the delivery costs applicable to the order are determined according to the place and method of delivery chosen by the customer at the time of validation of his order. these delivery costs are mentioned in the "deliveries and returns" section of the site, as it exists at the time of the order.

the customer receives, via the e-mail confirming the dispatch of his order, the tracking number assigned to the package allowing him to follow the delivery process of his order.

the delivery is made to the delivery address indicated by the customer, it being specified that this must be the residential address of the customer or of a natural or legal person of his choice. delivery cannot be made to hotels or to PO boxes. it is up to the customer to provide the exact and complete information necessary for the correct routing of his order and for the perfect delivery (such as, in particular: street number, building, staircase, access codes, names and/or numbers intercom, etc.).

delivery is deemed to have been made as soon as the order is made available to the customer by the carrier. the control system used by the carrier prevails.

if it is impossible to make the delivery due to an incorrect delivery address, no reshipment can be made and the customer will be reimbursed within 14 days of receipt of the order by salut beauté, via the means of payment used when ordering.

Salut Beauté delivers orders within the time limits mentioned in the “deliveries and returns” section of the site, as it exists at the time of the order, and no later than thirty days after the order has been validated.

Salut beauté cannot be held responsible for delays in delivery that are not its fault or justified by a case of force majeure (as defined below in article 11 of the general terms and conditions of sale).

if the delivery time is exceeded, the customer may write to salut@salut-beaute.com to request the status of the delivery and agree on a reasonable additional delivery time. if the customer has not received his order at the end of this new reasonable delivery period, he can denounce the sale by writing to salut@salut-beaute.com and obtain within a maximum period of 14 (fourteen) days the refund of all sums paid on the occasion of the order, via the means of payment used when ordering. if the order had already been dispatched at the time of the termination of the sale, the customer must return it to salut beauté to be reimbursed. for this, the customer writes to salut@salut-beaute.com upon receipt of his order, specifying his surname, first name, order number to obtain a prepaid return label. items must be returned in their original packaging, new, unworn, unwashed and with tags intact and attached. Salut beauté cannot be held responsible for the harmful consequences resulting from a delay in delivery. only reimbursement of sums paid when ordering by salut beauté is possible, to the exclusion of any other form of compensation.

 

withdrawal from the premises of salut beauté in paris (at les brendas)

if the customer chooses the option to collect his order from our premises in paris, it is up to him to send an e-mail to the address salut@salut-beaute.com in order to agree on a time slot for collecting the order. no delivery will be possible without prior appointment.

delivery is deemed to have been made as soon as the order is made available to the customer by hand against receipt.

in the event that the customer does not collect his order from the premises of salut beauté in paris at the agreed date and time, the customer will be reimbursed within 14 days, via the means of payment used when placing the order.

 

  1. returns and refunds

any non-professional consumer has a right of withdrawal, without having to justify reasons or pay penalties.

the customer has a period of 14 (fourteen) calendar days from the day after delivery to indicate that he wishes to make use of his right of withdrawal. beyond the said period of 14 (fourteen) days, the sale is firm and final and no return is possible.

if this 14-day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day. for example, in the event of receipt of the goods on January 10, the withdrawal period runs from January 11 to 24 inclusive. from the 25th, withdrawal is therefore no longer possible. if the 24th is a Saturday, the period runs until Monday the 26th.

the customer communicates his decision to withdraw by sending an e-mail to the address salut@salut-beaute.com, in which the customer specifies his surname, first name, order number and references of the article(s) qu he wishes to return.

 

from France

the customer has two options:

  • free return by colissimo

upon receipt of the return request made by the customer to the address salut@salut-beaute.com, salut beauté sends the customer a prepaid return label.

the customer fills in the return form present in the package and inserts the return form with the item(s) to be returned in the original package.

the customer sticks the prepaid return label on his package and ships it at the latest within 14 days of receiving the prepaid return label.

  • return to the premises of salut beauté

the customer can drop off his package at the salut beauté premises in paris, by appointment.

to do so, he requests an appointment when he sends his return request to the address salut@salut-beaute.com.


from the rest of the world

the return is the responsibility of the customer and is at his risk via the carrier of his choice.

the customer fills in the return form present in the package and inserts the return form with the item(s) to be returned in the original package.

the customer sends it at the latest within 14 days following the communication of his decision to withdraw.

the return is offered to the customer in the event that the item delivered does not conform to the order. in this case, the customer writes to salut@salut-beaute.com to receive a prepaid return label.

in any event, the item(s) must be returned in their original packaging, new and unworn, unwashed and with the tags intact and attached.

the reimbursement takes place provided that Salut Beauté has been able to recover the items initially delivered.

once the verification of the returned items has been carried out, salut beauté undertakes to reimburse the customer as soon as possible and at the latest within 14 (fourteen) calendar days following the date of receipt of the return package, using the same means of payment than the one that will have been used for the payment of the order.

in the absence of respect by the customer of the cgv, salut beauté cannot proceed to the refund of the articles concerned.

reimbursements are made in euros. any additional costs related to any costs of converting a foreign currency are the responsibility of the customer.

this return and refund procedure is exclusive of any exchange.

 

  1. legal guarantees

item not in accordance with the order or presenting an apparent defect

the presence of an apparent defect on an article must give rise to a complaint by e-mail (salut@salut-beaute.com). any complaint must explain the defect concerned. otherwise, no complaint is admissible, and no return or exchange is possible.

the item must be returned in its original packaging, new and unworn, unwashed and provided with the tags intact and attached, with the references of the initial order and a copy of the complaint to the head office of salut beauté, after the sending an e-mail indicating the apparent defect of the article referred to above.

cases of apparent defect give rise, depending on the content of the customer's complaint, either to the establishment of a credit note for the benefit of the customer, or to the replacement of the article, or to the outright reimbursement of the customer within a period of 14 (fourteen) days. in case of non-compliance with the return procedure, no exchange or refund or credit is possible.

in addition, salut beauté guarantees consumers against defects of conformity (articles l. 217-4 and following of the consumer code) and hidden defects (articles 1641 and following of the civil code) for the items for sale on the site within the following conditions:

 

noncompliance

the customer :

  • benefits from a period of 2 (two) years from the delivery of the article to act in default of conformity of the article;
  • is exempted from providing proof of the existence of the lack of conformity of the good during the 6 (six) months following the delivery of the article;
  • may choose between repairing or replacing the item, subject to the cost conditions provided for in article l. 217-9 of the consumer code.
  • if the repair and the replacement of the good are impossible, and in particular if the article is not available any more in stock at the time when the customer asserts the nonconformity of the article, the purchaser can return the good and be made return the price or keep the property and have part of the price returned.

 

hidden defects

the customer can implement the legal guarantee under the hidden defects of the thing sold, within the meaning of articles 1641 and following of the civil code, in the event that a hidden defect, prior to the sale and inherent in the article sold , renders this article unfit for its use or diminishes this use so much that the customer would not have acquired it, or would have given only a lower price for it, if he had known about it.

 

the latent defect must be a defect that even a used item should not have. thus, the guarantee against hidden defects cannot be retained when the defect is only the result of normal wear and tear of the thing or its prolonged use or even when the defect comes from improper use of the thing.

 

the legal guarantee against hidden defects allows the customer, within a period of 2 (two) years from the discovery of the defect, either to keep the item and request a price reduction, or to return the item and request a refund of the price paid, in accordance with article 1644 of the civil code.


  1. responsibility

the hypertext links established in the direction of other sites from the salut-beaute.com site cannot, under any circumstances, engage the responsibility of the director of the publication.

Salut beauté is only liable for any direct and foreseeable damage at the time of use of the site or the conclusion of the sales contract with the customer, excluding any indirect damage.

the responsibility of salut beauté with regard to any item purchased on the site is strictly limited to the purchase price of the latter.

Salut Beauté shall in no event be liable for the following losses, regardless of their origin:

  • loss of revenue or sales;
  • operating loss ;
  • loss of profits or contracts;
  • loss of anticipated savings;
  • data loss ;
  • loss of work or management time;
  • image damage;
  • loss of opportunity, and in particular of ordering an item;
  • moral damage.

salut beauté reserves the right to modify the information contained in this site at any time and without notice.

salut beauté undertakes to describe with the greatest accuracy the items sold on the site and to ensure that the information disseminated therein is kept up to date in the best possible conditions. however, Salut Beauté cannot guarantee the accuracy, precision or completeness of the information made available to customers on the site.

in the event of non-substantial differences between the presentation photos of the articles on the site, texts and illustrations and the articles ordered, the responsibility of salut beauté will not be engaged.

the documents, descriptions and information relating to the articles appearing on the site are not covered by any guarantee, explicit or implicit, with the exception of the guarantees provided for by law.

Hi Beauty makes no warranty regarding any harm that may be caused by the transmission of any computer virus, worm, time bomb, trojan horse, cancelbot, logic bomb or any other form of programming routine designed to damage, destroy or otherwise impair the functionality of a computer or to interfere with the proper working of it, including any transmission resulting from a download of any content made by the client, the software used by the client to download the content, the site or the server that allows access to it. in this respect, the customer acknowledges that it is his responsibility to install appropriate anti-virus and security software on his computer equipment and any other device in order to protect them against any bug, virus or other programming routine of this order proving harmful.

the customer acknowledges assuming all risks associated with any content downloaded or otherwise obtained through the use of the site and agrees that he is solely responsible for any damage caused to his computer system or any loss of data resulting from the downloading of this content.

Salut beauté is only required to deliver items that comply with the contractual provisions. the items are considered to comply with the contractual provisions if the following conditions are met: (i) they must comply with the description and have the characteristics displayed on the site; (ii) they must be suitable for the purposes for which such articles are generally designed; (iii) they must meet the quality and resistance criteria which are generally accepted for articles of the same type and which can reasonably be expected.

Salvation Beauté cannot be held liable in the event of a breach of one of its contractual obligations resulting from a fortuitous event or a case of force majeure as defined by the case law of the French courts and tribunals.

in particular, salut beauté will not be held responsible for any non-execution or delay in the execution of orders, caused by events beyond its control (“ case of force majeure ”).

a case of force majeure includes any act, event, non-completion, omission or accident beyond the control of salut beauté and includes in particular, without limitation:

  • strikes, factory closures;
  • war, invasion, terrorist attack or threat of terrorist attack, civil unrest or war, riot;
  • disaster, natural disasters or epidemics;
  • impossibility of using private or public means of transport due to strikes, breakdowns or accidents;
  • inability to use public and private telecommunications networks;
  • facts of the prince.

All the obligations of Salut Beauté and the customer are suspended for the duration of the case of force majeure, without compensation, and the execution and delivery times will be extended accordingly. Salut beauté will endeavor as far as possible to find a solution allowing it to perform its contractual obligations despite the case of force majeure. if the case of force majeure continues for more than 3 (three) months, the transaction concerned may be terminated at the request of salut beauté or the customer without compensation on either side. non-payment by the customer cannot be justified by a case of force majeure.

 

  1. customer service

for any information or question, for order tracking, or to invoke the warranty, the customer must contact customer service by completing the contact form located on the "contact" page of the site or by e-mail at following address: salut@salut-beaute.com.

 

  1. Protection of personal data

the customer is informed and accepts that his personal data may be collected on the site and used by salut beauté, which acts as data controller within the meaning of law 78-17 of January 6, 1978 relating to data processing, files and to freedoms as modified on January 20, 2017 and as it will be modified by the general regulation (eu) on data protection 2016/679 dated April 27, 2016 (hereinafter the “IT and freedoms law” ) .

salut beauté undertakes to protect and ensure the security and confidentiality of its customers' personal data in accordance with the Data Protection Act, in particular by taking all necessary precautions to prevent this data from being distorted, damaged or that unauthorized third parties have access to it. it is specified that the site is hosted by shopify, inc., which provides hi beauty with an online e-commerce platform to sell products and services and that the customer's personal data is stored via shopify's data storage, its databases and the general shopify application. shopify stores this personal data on a secure server protected by a firewall. if the customer is located in the european economic area, their personal data is processed by shopify's irish subsidiary, shopify international ltd.

in the event of a violation of personal data, salut beauté notifies the violation in question to the cnil as soon as possible. if the violation of personal data is likely to create a high risk for the rights and freedoms of a customer, salut beauté informs the person concerned as soon as possible of the violation of personal data.

customers' personal data may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the Data Protection Act, intervene and contribute directly to the management of orders and for whom it is absolutely necessary to access the personal data provided by the customer when creating and using his account (identity, postal address, telephone number, email address). subcontractors may only act on instructions from salut beauté.

personal data is also kept for security purposes, in order to comply with legal and regulatory obligations and to allow Salut Beauté to improve and personalize the services offered to customers and to inform them of related offers and commercial information. with the brand.

the customer's personal data is only kept for the duration strictly necessary for the purposes previously explained. in particular, the customer's personal data which is collected:

  • for the purposes of order management and customer relations and customer information cannot be kept beyond the time strictly necessary for the management of the commercial relationship with the customer;
  • for commercial prospecting purposes may be kept for a period of three years from the end of the commercial relationship with the customer.

the personal data of the non-customer prospect may be kept for a period of three years from their collection by salut beauté or the last contact from the prospect.

If the customer chooses a direct payment gateway to complete their order, Shopify saves their credit card data, which is encrypted through the PCI-DSS (payment card industry data security standard). the data relating to the purchase transaction are only kept for the time necessary to complete the purchase transaction and are deleted as soon as the said transaction is completed.

In accordance with the Data Protection Act, the customer has a right of access, rectification and opposition to personal data concerning him and the right to lodge a complaint with a supervisory authority, the right to limitation of processing, the right to erasure of data and the right to data portability (hereinafter the " IT rights and freedoms ").
